German Court Grants Silimed Preliminary Injunction in Patent Dispute
The Regional Court of Munich has issued a preliminary injunction against Polytech Health and Aesthetics GmbH, prohibiting the manufacture, sale, and distribution of certain breast implants in Germany. This ruling comes after a near decade-long litigation between Polytech and the Brazilian company, Silimed Indústria de Implantes Ltda, over patented polyurethane-coated implant technology.
Silimed, the sole global manufacturer of these implants, has seen a favorable judgment supporting its patent validity. The court has imposed a potential fine of up to 250,000 euros per breach for Polytech if it fails to comply. The ruling also restricts Polytech from supplying distributors outside Germany, solidifying Silimed's position in a significant market.
The dispute traces back to a patent awarded to Silimed by the Frankfurt Higher Regional Court in December 2024, which the German Federal Court of Justice upheld in late 2025. Currently, Polytech's appeal is pending with the Munich Court of Appeals. This legal win marks a crucial victory for Silimed in safeguarding its market leadership and technology.
